Terms of Use
Last updated 2026-10-31
These Terms of Use (the "terms") are a binding legal agreement between you and the person who operates Trading Journal at futures-trading-journal.online (the "operator", "we", "us"). They apply to everyone who visits, creates an account on or uses Trading Journal, its website, the NinjaTrader add-on, the AI coach and every related feature (together, the "service"). By ticking the box when you create an account, or by using the service in any way, you confirm that you have read, understood and agree to these terms and the Privacy Policy. If you don't agree, don't use the service.
Please read sections 1, 13, 14, 15, 16 and 19 carefully. They say the service is not financial advice, that it comes with no warranty, that the operator's liability is limited as far as the law allows, and that disputes are settled by individual binding arbitration — not in court, not by a jury and not as a class action — unless you opt out as section 19 explains.
1. Not financial advice
Trading Journal is a record-keeping and self-review tool only. Nothing in the service — including statistics, charts, P&L, R multiples, prop-firm rule checks, balance checks, verified records, reviews, community posts, shared trades and anything the AI coach says — is financial, investment, trading, tax, accounting or legal advice, a recommendation or solicitation to buy or sell any security, future or other instrument, or an offer of any financial service. The operator is not a broker, dealer, investment adviser, commodity trading advisor, futures commission merchant or fiduciary, is not registered with any regulator, and owes you no fiduciary duty.
Trading futures and other leveraged instruments involves substantial risk of loss, can lose more than you deposit, and is not suitable for everyone. Past results — including any shown in your journal, on the Verified page, in Community or shared by other people — do not guarantee or indicate future results. You alone are responsible for every trading decision you make and for all of its results. Consult a licensed professional before making financial decisions.
2. No reliance on figures
Figures are calculated automatically from data you enter, import or sync, and from contract specifications, fee schedules and prop-firm rule presets that may be incomplete, wrong or out of date. Data from brokers, platforms and CSV files can be missing, delayed, duplicated or incorrect. Prop-firm presets are summaries of rules published by those firms and can change without notice; always check the firm's own rules. The service is not your official record for taxes, firm payouts, evaluations, account compliance or any legal purpose — your broker's and firm's statements are the official records. You must check every figure yourself before relying on it, and you rely on the service at your own risk.
3. Third-party services
The service works with services the operator doesn't own or control, including brokers and trading platforms (such as NinjaTrader, Tradovate, Rithmic, Topstep/TopstepX, tastytrade and Interactive Brokers), prop firms, Google (which runs the AI coach), Cloudflare (which hosts the service) and email providers. Their availability, accuracy, security, data, terms and fees are their responsibility, not the operator's. Connecting an account is your choice and at your own risk; you are responsible for complying with your broker's, platform's and prop firm's terms (including any rules about third-party tools or data sharing). Broker connections are read-only — the service never places, changes or cancels orders — but you are responsible for the credentials and API keys you create and for revoking them when you stop using the service.
The NinjaTrader add-on runs on your own computer. You install and run it at your own risk; it is provided "as is", it is designed only to read your executions and never to trade, and the operator is not responsible for any effect it has on your computer, platform, orders or account.
4. The AI coach
The optional AI coach ("Vega") generates answers with a third-party AI model (Google Gemini). Its answers can be wrong, incomplete, out of date or made up, and are never financial advice or professional advice of any kind, including medical or mental-health advice. It is off until you opt in. When you use it, the journal data needed to answer is sent to Google to produce the reply (see the Privacy Policy). Don't act on anything it says without checking it yourself.
5. Who can use it
You must be at least 18 years old and legally able to enter a binding contract, and you must not be barred from using the service under the laws that apply to you. Use the service only for your own trading records. You are responsible for making sure your use is legal where you live.
6. Your account
Keep your password private and use one you don't use elsewhere; turning on two-step sign-in and a recovery email is strongly recommended. You are responsible for all activity under your account, whether or not you authorised it. Sign out on shared devices. Tell the operator at alecio.trades@gmail.com straight away if you think your account has been used by someone else. The operator is not liable for any loss caused by someone using your account or credentials.
7. Acceptable use
Don't: break any law with the service; upload anything you don't have the right to upload, or anything illegal, malicious, infringing or abusive; harass, threaten or defraud anyone through friends, messages, groups, comments or Community; try to get into other people's accounts or data; probe, scan, scrape, overload, reverse-engineer or attack the service or get around its security or limits; create accounts in bulk or with automated tools; use the service to build a competing product; or resell, copy or sublicense the service.
In the Community chat (visible to everyone with an account) also don't: post hate, threats or harassment; spam or advertise; sell or promote signals, courses, accounts or financial services, or run scams; impersonate anyone; give or claim to give financial advice; or share other people's private information.
8. Community, sharing and moderation
Content posted or shared by other users (messages, comments, shared trades and accounts, verified results) is their responsibility alone. The operator doesn't check, endorse or guarantee it, has no duty to monitor it, and is not responsible for it or for anything you do because of it. Never treat another user's posts or results as advice. Anyone can report a message. The operator may, at their sole discretion and without notice or liability, remove any content, mute someone in the chat for 24 hours or permanently, or suspend or ban any account. A banned account can't sign in; its data is kept and can be exported on request.
9. Verified accounts and records
"Verified" only means the service received an account's trades from a connected broker's API and nothing in it was changed by hand since it was verified. It is not an audit, a certification, an endorsement or a guarantee of anyone's results, honesty or future results, and it is not financial advice. Prop-firm accounts usually trade simulated money. Don't present it as more than that, and don't try to make it show something that didn't happen. The operator may remove a verification at any time.
10. Your content
You keep ownership of what you put in your journal. You give the operator a non-exclusive, worldwide, royalty-free licence to store, copy, process and display it only as needed to run the service — to show it to you and to the people you choose to share it with, and to send what the AI coach needs to Google when you use it. Comments you write on someone else's trade are shown to that trade's owner and the people they share it with, and the owner can delete them. What you post or share in Community is shown to everyone with an account until you delete it; if you verify a trading account, anyone you share it with sees that it's verified. You promise you have the right to everything you upload. You can export or delete your data at any time in Settings → Data.
If you send ideas or feedback, the operator may use them freely without paying or crediting you.
11. The operator's rights
The service, its software, design, text and branding belong to the operator and are protected by law. These terms give you only a personal, revocable, non-transferable right to use the service as offered; they don't give you any other rights in it.
12. Data, security and backups
The operator uses reasonable measures to protect the service, but no system is perfectly secure. The operator doesn't guarantee that your data will be kept safe, private, accurate or available, and is not liable for any loss, corruption, unauthorised access to or disclosure of data, except where the law does not allow that to be excluded. Keep your own copies of anything important (Settings → Data → Export) and keep your broker's statements.
13. Free service, no warranty
The service is provided free of charge, "as is" and "as available", with all faults and without warranties of any kind, whether express, implied or statutory, including any warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, reliability, security, availability or quiet enjoyment, and any warranties arising from a course of dealing or usage of trade. The operator does not warrant that the service will be uninterrupted, timely, secure or error-free, that figures or data will be correct or complete, that defects will be fixed, or that the service will keep working. It may change, be unavailable, lose data or stop at any time without notice. No advice or information, oral or written, from the operator or the service creates any warranty.
14. Limitation of liability
To the fullest extent permitted by law, the operator and anyone acting for the operator will not be liable to you or anyone else for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any trading or investment losses, lost profits, revenue, savings or opportunities, failed or lost prop-firm evaluations, funded accounts or payouts, missed trades, lost or corrupted data, account suspensions by third parties, or costs of substitute services, arising out of or relating to the service or these terms, however caused and under any theory of liability (contract, tort including negligence, strict liability or otherwise), even if advised of the possibility of such damages.
To the fullest extent permitted by law, the operator's total liability for all claims of any kind arising out of or relating to the service or these terms is limited to the greater of (a) the amount you paid the operator for the service in the 12 months before the claim arose (which, for this free service, is zero) or (b) ten US dollars (US $10).
These limits are an essential part of the agreement: the service is offered free only because of them. Some places don't allow certain warranties or liabilities to be excluded or limited; there, they apply only to the extent the law allows, and nothing in these terms limits liability that can't legally be limited (for example for fraud or for death or personal injury caused by negligence where the law forbids it).
15. Your responsibility and release
You use the service entirely at your own risk and accept all risks of trading. To the fullest extent permitted by law, you release the operator from all claims, demands and damages (known and unknown) arising out of or relating to your trading, other users, third-party services, or your use of the service. If you are a California resident, you waive California Civil Code section 1542, which says: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party." You waive any similar law elsewhere.
16. Indemnity
You agree to defend, indemnify and hold harmless the operator and anyone acting for the operator from and against all claims, damages, losses, liabilities, fines, costs and expenses (including reasonable lawyers' fees) arising out of or relating to your use or misuse of the service, your content, your trading, your breach of these terms, or your violation of any law or anyone else's rights. The operator may take control of the defence of any such claim, and you will cooperate.
17. Suspension and ending your use
You can stop using the service and delete your account at any time in Settings → Data. The operator may suspend, limit or close any account, remove any content, or change, suspend or shut down all or part of the service at any time, for any reason or no reason, with or without notice, and without liability to you. Sections 1–4, 8–10, and 12–21 continue to apply after your use ends.
18. Changes to these terms
The operator may update these terms at any time. The date at the top shows the latest version. Continuing to use the service after a change means you accept the updated terms; if you don't agree, stop using the service and delete your account.
19. Disputes: arbitration and class-action waiver
Talk first. Before starting any claim, you agree to email alecio.trades@gmail.com with a description of the problem and try to resolve it informally for at least 60 days.
Binding individual arbitration. If it isn't resolved, any dispute, claim or controversy arising out of or relating to the service or these terms (including whether this section applies) will be settled by final and binding arbitration on an individual basis, administered by the American Arbitration Association under its Consumer Arbitration Rules, and governed by the Federal Arbitration Act. The arbitration may be held by video or phone, or in the county where you live. Either side may instead bring an individual claim in small-claims court if it qualifies. The arbitrator may award the same individual relief a court could, but only to you individually.
You and the operator each waive the right to a trial by jury and the right to bring or take part in any class, collective, consolidated or representative action or arbitration.
Time limit. To the fullest extent permitted by law, any claim must be started within one (1) year after it arose, or it is permanently barred.
Opting out. You can opt out of arbitration by emailing alecio.trades@gmail.com with your username and the words "arbitration opt-out", within 30 days after you first agreed to these terms. If you opt out, or if this section is found unenforceable, disputes will be decided only by the state or federal courts in the operator's home county, and you and the operator agree to those courts' jurisdiction. If the class-action waiver is found unenforceable for a claim, that claim must be decided in court, not in arbitration.
20. Governing law
These terms and any dispute about the service are governed by the Federal Arbitration Act, federal law of the United States and the laws of the U.S. state where the operator lives, without regard to conflict-of-law rules. The service is run from the United States and is not intended for use where it would break local law.
21. General
These terms and the Privacy Policy are the entire agreement between you and the operator about the service and replace any earlier ones. If any part of these terms is found unenforceable, it will be enforced as far as possible and the rest stays in full effect. The operator's failure to enforce any part isn't a waiver of it. You may not transfer your rights under these terms; the operator may transfer them, for example if the service is sold. The operator isn't liable for delays or failures caused by events outside the operator's reasonable control (such as outages at hosting, broker or AI providers, internet failures, attacks or natural events). Headings are for convenience only.
